By accessing or using the Innerview platform (the “Service”), provided by Innerview (“Innerview,” “we,” “us,” or “our”), you (“User” or “you”) agree to be bound by these Terms and Conditions of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Innerview is a platform designed to provide users with anonymous feedback from friends, family, and colleagues through predefined tests and assessments. Users can create test instances, share them, collect ratings on a 1-5 scale, and view reports summarizing the feedback. The Service may include features such as:

• Personality, Relationship, Leadership, and other predefined tests
• Creation of unique test instances and shareable links
• Anonymous feedback collection via 1-5 Likert scale questions
• Visual reports and summaries of collected feedback
• Optional premium AI-powered analysis and insights (subject to credit purchase)
• Credit-based system for accessing premium features

3. User Accounts and Responsibilities

To utilize certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Notify us immediately of any unauthorized access to or use of your account
• Not use another user's account without permission

The Service and its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Innerview, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your Web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution

6. Payments and Credits

Certain features of the Service, such as access to detailed reports or AI-powered analysis, may require the purchase of credits.

• Credit Purchase: Credits can be purchased through Stripe or other payment methods as indicated on the Service. You agree to pay all charges at the prices then in effect for your purchases and authorize us to charge your chosen payment provider.
• Credit Usage: Credits are deducted from your account balance when you access premium features. Credit balances are non-refundable and have no cash value.
• Pricing: We reserve the right to change our credit prices at any time. We will provide reasonable notice of any such changes by posting the new prices on the Service.
• Taxes: You are responsible for any applicable taxes associated with your purchases.

INNERVIEW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL INNERVIEW, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Anonymous Feedback: You acknowledge and agree that the feedback provided through the Service is anonymous and reflects the opinions of the respondents, not Innerview. Innerview is not responsible for the content or accuracy of the feedback provided. The Service is intended for personal growth and development and should not be used for making critical decisions about individuals.

9. Indemnification

You agree to defend, indemnify, and hold harmless Innerview, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law provisions.
